Importantly, this notice is also referred to as a<a href=\"https:\/\/www.uslegalforms.com\/us\/US-00870BG.htm?auslf=ne2018\" target=\"_blank\" rel=\"noopener\"> notice to Cure or Quit<\/a>. For common eviction reasons, such as failure to pay rent and staying past the final date on the lease, landlords should file a 3 Day Notice. This next step requires a landlord to file a case called a <a href=\"https:\/\/www.legis.iowa.gov\/docs\/code\/648.pdf\" target=\"_blank\" rel=\"noopener\">Forcible Entry and Detainer<\/a>. This requires the landlord to go to the Clerk of the Court located in the same county where the property is located. Next, the landlord needs to request the <a href=\"https:\/\/www.legis.iowa.gov\/publications\/search\/document?fq=id:1282080&amp;pdid=1232112&amp;q=646#646.24\" target=\"_blank\" rel=\"noopener\">Writ of Possession form<\/a> from the County Clerk. Note, this should be for the same county where the property is located. After the form is requested, the County Clerk will send it to the Sheriff\u2019s Office. The sheriff is responsible for delivering the notice to the tenant and will set a time and date for physical removal. Usually, the tenant will leave before they are physically removed.
